What should you do if you’re pulled over and have a gun in your car?
Laws for carrying guns in your car vary based on the state that you’re in. So, be aware of the laws in your state.
For example, Texas doesn’t require you to have a concealed carry license to have a gun in your car. But Texas prohibits intentionally, knowingly, or recklessly carrying a handgun in plain view in a motor vehicle.
In North Carolina, you need a concealed carry license if your gun is hidden from view or in an easily accessible location for vehicle occupants.
You don’t need a concealed carry permit in North Carolina if the gun is in view or kept in an inaccessible location for passengers. For example, a gun can be locked in your glove box.
If you get pulled over with a gun in your car, stay calm and polite. Keep your hands on the steering wheel or dashboard as the officer approaches your car and for the beginning of the conversation.
Some state and local laws require you to tell law enforcement officers if you have a gun. In Louisiana, it’s your duty to tell the officer about it.
In Florida there is a don’t ask don’t tell policy, so you only have to mention your gun if the officer asks if you have a weapon.
Keep your hands still as you tell the cop about your weapon. They may ask to see your gun and your permits depending on your state laws. Don’t argue with an officer or escalate the situation.
It’s legal for the police officer to disarm or remove the gun for their safety during a traffic stop. But the gun will be returned at the end of the interaction if you’re legally carrying it.
If you can’t show proof of ownership, then your gun might be seized and taken to the station. It will be returned once you can provide proof of ownership.
